Applicable Product Categories and VOC Limits

  • Air fresheners (single-use): Maximum 70% VOC by weight (excluding ethanol and water for certain subcategories).
  • Air fresheners (refill containers): Maximum 70% VOC by weight.
  • General-purpose air fresheners (aerosol): Maximum 25% VOC by weight.
  • Candles and solid air fresheners: Exempt from VOC content limits under Section 94509(a) but subject to labeling and ingredient disclosure requirements.
  • Scented oils and liquid potpourri: Classified under “general purpose” consumer products with a 70% VOC limit unless the product is 100% essential oil (exempt under Section 94508(b)(2)).

These limits are calculated as weight percent of total product content, excluding water and exempt compounds listed in Section 94508(b). Ethanol is not exempt in California, unlike under some federal frameworks, which catches many formulators off guard.

CARB requires VOC content determination using methods specified in Section 94510:

  • Method 310 (Determination of Volatile Organic Compounds in Consumer Products) for most liquid products.
  • ASTM D2369 or EPA Method 24 for coatings and related products.
  • Gas chromatography (GC-FID) for individual compound identification when exempt compound claims are made.

Buyers should request that manufacturers provide third-party lab reports using these specific methods. A generic “VOC content” statement without reference to the prescribed methodology will not satisfy CARB enforcement officers or California retailers’ compliance departments.

Labeling and Ingredient Disclosure

Section 94512 requires consumer product labels to include:

  • Product category identification.
  • VOC content expressed as grams per liter or weight percent.
  • A statement of compliance or the applicable exemption.
  • Manufacturer name and contact information.

Additionally, California’s Proposition 65 (Safe Drinking Water and Toxic Enforcement Act of 1986) requires warning labels if the product contains any listed chemical above safe harbor levels. Common fragrance ingredients such as benzyl alcohol, cinnamaldehyde, and certain phthalates appear on the Proposition 65 list.   4. Proposition 65 screening results for listed chemicals, with quantitative levels relative to safe harbor thresholds (e.g., 0.0005% for reproductive toxicants).
  5. Label proofs showing required VOC content declarations and category identification.
  6. Certificates of Analysis (CoA) for each production batch shipped to California.

Enforcement and Penalties

CARB enforcement actions can result in penalties of up to $50,000 per day per violation under California Health and Safety Code Section 42410. Retailers such as major California chains routinely require suppliers to provide CARB compliance certificates before listing products. Non-compliant goods identified at distribution centers may be quarantined, returned, or destroyed at the importer’s expense.

Practical Guidance for Buyers Sourcing from China

When working with overseas manufacturers, buyers should:

  • Specify CARB compliance as a contractual requirement in purchase agreements, referencing the exact product category and VOC threshold.
  • Require pre-shipment VOC testing by an ISO 17025-accredited laboratory using CARB Method 310.
  • Confirm that ethanol content is accounted for in VOC calculations, as California does not grant the ethanol exemption that some other jurisdictions allow.
  • Verify that fragrance oil dilution ratios keep the finished product below the applicable VOC cap.
  • Request batch-specific CoAs rather than annual blanket certificates, as formulation drift between production runs can push VOC content above limits.
