Do I Need a Registered Brand to Order Private Label Fragrance?
No. You do not need a registered trademark, a business license, or even a company entity to place a private label fragrance order with most Chinese factories, including Aromiso. Here is what you actually need, and when formal brand registration becomes important.
What You Need to Place a Private Label Order
The practical requirements are minimal:

A brand name and logo design. This can be a name you have chosen but not yet registered. You need a print-ready logo file (AI, PDF, or high-resolution PNG at 300 DPI minimum) for label production.

Product specifications. What you want: candle type, size, scent, container, packaging format. You do not need to be a chemist. Factories guide you through options.

A shipping address and payment method. That is it for the transaction itself.

Label content decisions. Product name, net weight, ingredients list, warning text, and country-of-origin marking. The factory provides regulatory templates; you supply your brand name and contact details.

When Does Trademark Registration Actually Matter?
Trademark registration is not required for production or export. It becomes important at these stages:
1. Selling on Amazon, Walmart Marketplace, or similar platforms
Amazon Brand Registry requires a registered trademark (or a pending application in some markets). Without it:
- You cannot create A+ Content or Brand Store pages.
- You have no protection against hijackers listing counterfeit versions of your product.
- You cannot use your brand name in the product title with the same authority as registered sellers.
You can still sell on Amazon without a trademark, but you are vulnerable. We recommend filing a trademark application before your first shipment arrives. US trademark applications (USPTO) cost $250 to $350 per class and take 8 to 12 months to register. You can sell during the pending period.
2. Entering retail chains
Buyers at Target, Ulta, HomeGoods, and similar retailers will ask for proof of trademark registration or at least a pending application. They need assurance that your brand name will not create legal exposure for them.
3. Protecting against copycats
If your product succeeds, someone will copy it. A registered trademark gives you legal grounds to issue takedown notices, file customs seizure requests, and pursue infringement claims. Without registration, your options are limited.
4. EU and UK markets
If you sell in the EU, you need a Responsible Person (RP) under EU Cosmetics Regulation for skin-contact products. For candles and diffusers (non-cosmetic), you need CLP-compliant labeling. Neither requires a trademark, but having one simplifies distributor agreements.
Can the Factory Use Your Unregistered Brand Name?
Yes. The factory prints whatever brand name and logo you provide. They do not verify trademark status. This is your responsibility.
Important: Before finalizing your brand name, run a basic trademark search:
- US: USPTO TESS database (free, search at tmsearch.uspto.gov)
- EU: EUIPO eSearch plus (free)
- UK: IPO trademark search (free)
- Global: WIPO Global Brand Database (free)
A 30-minute search can save you from choosing a name that is already registered in your target market. If you find a conflict, change the name before ordering 5,000 units with it printed on every label.
What About the Factory’s Role in Branding?
At Aromiso, we offer two levels of branding support:
Level 1: You provide everything
You send us your logo, label artwork, and packaging design files. We print and apply them. This is the most common arrangement. Cost: included in unit price.
Level 2: We assist with design
Our in-house design team creates your label layout, packaging dieline, and basic brand identity. This is available for orders of 1,000 units or more. Cost: $200 to $500 for label design, $300 to $800 for full packaging design.
Neither level requires you to have a registered trademark. We simply need your written authorization to print your brand name, which is a standard clause in our production agreement.
What Legal Documents Do You Actually Need?
For a first private label order, you need:
- Purchase order or production agreement with the factory (the factory provides the template)
- Label artwork approval (you sign off on the final label proof)
- Compliance documents for your market (the factory provides SDS, IFRA certificates, and allergen declarations)
You do NOT need:
- A registered trademark (recommended but not required)
- A business license (depends on your country’s import rules, not the factory’s requirements)
- A cosmetics or product safety license (for candles and diffusers in most markets)
How to Protect Your Brand From Day One (Without Registration)
While your trademark application is pending:
- Keep all design files and correspondence dated. This establishes prior use.
- Use the TM symbol (not the R-in-circle symbol, which requires registration) on your packaging.
- Register your brand name as a domain and on social media platforms immediately.
- File your trademark application early. In the US, you can file on an “intent to use” basis before you have sold a single unit.
