Product Safety Assessment for Fragrance: CPSR and Risk Evaluation
Before any cosmetic product containing fragrance can be legally sold in the EU, it must undergo a formal safety assessment documented in a Cosmetic Product Safety Report (CPSR). This requirement, under Regulation (EC) No 1223/2009 Article 10 and Annex I, applies to perfumes, scented lotions, fragranced soaps, and any product meeting the cosmetic definition. For B2B buyers, understanding the CPSR process is essential for market access and liability management.
Legal Basis
Article 10(1) requires that “the responsible person shall ensure that the cosmetic product has undergone a safety assessment on the basis of the relevant information and that a cosmetic product safety report is set up in accordance with Annex I.” The CPSR must be completed before market placement, performed by a qualified assessor holding a diploma in pharmacy, toxicology, medicine, or a similar discipline (Article 10(2)).
For non-cosmetic fragrance products (candles, diffusers, room sprays), a CPSR is not required. However, a general risk assessment is necessary under GPSR (EU) 2023/988, and chemical safety assessments may be required under REACH Article 14 for substances above 10 tonnes per year.
Structure of the CPSR (Annex I)
Part A: Cosmetic Product Safety Information

Quantitative and qualitative composition. Full formulation with exact percentages. For fragrance compounds, this includes the complete parfum breakdown with INCI names, CAS numbers, and EC numbers.

Physical and chemical characteristics. pH, viscosity, flash point, stability data.

Microbiological quality. Challenge test per ISO 11930 and limits per ISO 17516. Water-based fragrance products require particular attention.

Impurities and packaging information. Heavy metals (lead below 20 ppm, arsenic below 5 ppm, mercury below 1 ppm, cadmium below 5 ppm per SCCS guidance), residual solvents, nitrosamines, and packaging migration data.

Normal and reasonably foreseeable use. Application frequency, area, and exposed population.

Exposure to the product. Systemic Exposure Dose (SED) calculation based on application amount, frequency, and body surface area (per SCCS Notes of Guidance, 12th revision).

Toxicological profile. For each ingredient: acute toxicity (LD50/LC50), skin/eye irritation, skin sensitization (LLNA per OECD TG 429), repeat-dose toxicity (NOAEL), genotoxicity (Ames test per OECD TG 471), carcinogenicity, reproductive toxicity, and toxicokinetics.

Undesirable effects. Compilation of reported adverse reactions.
Part B: Cosmetic Product Safety Assessment
- Assessment conclusion. Whether the product is safe, safe with conditions, or not safe.
- Labeled warnings. Any required label warnings resulting from the assessment.
- Reasoning. Scientific rationale including Margin of Safety (MoS) calculations. A minimum MoS of 100 is required (NOAEL/SED must exceed 100) per SCCS Notes of Guidance.
- Assessor credentials. Name, qualifications, and signature.
Fragrance-Specific Considerations
Skin sensitization. Fragrance materials are among the most common causes of allergic contact dermatitis. The assessor evaluates each sensitizing component using QRA methodology. The Consumer Exposure Level (CEL) must not exceed the Acceptable Exposure Level (AEL) derived from the NESIL.
CMR substances. Article 15 prohibits CMR Category 1A, 1B, and 2 substances, with limited exceptions for Category 2 evaluated by the SCCS. Some fragrance ingredients (nitro-musks, HICC/Lyral) have been prohibited on this basis.
Natural materials. Essential oils contain dozens of chemicals, some restricted. Tea tree oil has been assessed by the SCCS (SCCS/1633/21) with specific concentration limits.
Phototoxicity. Citrus-derived materials (bergamot, lime, lemon oil) contain furocoumarins causing phototoxic reactions. Evaluate per OECD TG 432 (in vitro 3T3 NRU phototoxicity test) and ensure IFRA compliance.
Documentation the Buyer Must Obtain
As a B2B importer, you or your EU Responsible Person must hold:
- The complete CPSR (Parts A and B)
- The Product Information File (PIF) per Article 11, containing the CPSR, product description, GMP evidence (ISO 22716), proof of claimed effect, and animal testing declaration
- CPNP notification confirmation
- Label artwork with all required elements including allergen declarations
Retain these for 10 years after the last batch is placed on the market (Article 11(3)).
Non-Cosmetic Products: GPSR Risk Assessment
For candles, diffusers, and air fresheners, conduct an internal risk analysis under GPSR Article 5 covering:
- Chemical hazards (fragrance composition, CLP classification)
- Physical hazards (flammability, hot surfaces, glass breakage)
- Foreseeable misuse (child ingestion of diffuser liquid)
- Vulnerable populations (children, elderly)
Reference harmonized standards (EN 15493 for candle safety, EN 15494 for candle labeling) and document in the technical file.
