Germany combines the EU’s strictest enforcement culture with one of its most demanding consumer bases. For B2B buyers importing fragrance products, from reed diffusers and room sprays to essential oil blends and scented candles, compliance is the difference between a smooth retail launch and a shipment held at Hamburg or Frankfurt. This guide explains the regulatory framework in practical terms.

1. CLP Regulation (EC) No 1272/2008

The Classification, Labelling and Packaging Regulation is the foundation for nearly every fragrance product sold in Germany. Most home fragrance products are classified as mixtures and must carry:

  • Hazard pictograms, typically GHS02 (flammable), GHS07 (irritant), and sometimes GHS08 (health hazard) or GHS09 (aquatic toxicity).
  • Signal words in German: “Gefahr” or “Achtung”.
  • H-statements and P-statements translated into German.
  • Nominal content in metric units.

Reed diffusers with alcohol-based carriers almost always carry GHS02 because their flash point is below 60 degrees Celsius. Room sprays are additionally subject to aerosol-specific rules under Directive 2008/47/EC if they use pressurized containers.

Since 1 January 2021, hazardous mixtures must also be notified through the ECHA Poison Centres portal, and a unique formula identifier (UFI) must appear on the label. The German BfR receives these notifications and cross-checks them during market surveillance.

2. REACH Regulation (EC) No 1907/2006

REACH applies to every chemical substance in your product, including fragrance ingredients. Key obligations for importers:

  • Registration: Substances imported above 1 tonne per year per legal entity must be registered with ECHA. Most buyers rely on their manufacturer’s or only representative’s registration.
  • SVHC list: The Candidate List of Substances of Very High Concern is updated twice a year and now contains more than 240 substances. Articles containing SVHCs above 0.1 percent w/w trigger communication duties under Article 33.
  • Annex XVII restrictions: Several fragrance-adjacent substances, including certain phthalates and CMR substances, are restricted in consumer products.

3. IFRA Standards and Fragrance Concentration

The International Fragrance Association’s Standards, currently in their 51st amendment, set maximum usage levels for individual fragrance materials across product categories. Home fragrance products fall under Category 12 (non-skin-contact products), but candles, diffusers, and sprays each have specific limits.

German retailers often go beyond IFRA and request:

  • An IFRA certificate per fragrance oil.
  • A full allergen declaration covering the 26 (now expanded to 80+) EU-listed fragrance allergens.
  • Confirmation that no CMR 1A/1B substances are present above threshold levels.

4. GPSR (EU) 2023/988

The General Product Safety Regulation, fully applicable since December 2024, introduced new obligations that directly affect fragrance importers:

  • A named EU Responsible Person for non-EU manufacturers.
  • Online listings must display manufacturer and Responsible Person details.
  • Traceability requirements: batch numbers, production dates, and a documented technical file.
  • A 10-year record-keeping duty for economic operators.

Amazon.de, OTTO, and Zalando have all updated their seller policies to enforce these requirements, and listings without a Responsible Person are removed automatically.

5. German-Specific Requirements

Beyond EU-wide rules, Germany adds several national layers:

  • Chemikalienverbotsverordnung (ChemVerbotsV): Self-service sales of certain hazardous mixtures are restricted. Some concentrated essential oils and room sprays may require restricted-sale labeling.
  • VerpackG and LUCID: Packaging registration with the Zentrale Stelle Verpackungsregister is mandatory.
  • Preisangabenverordnung (PAngV): Unit pricing (price per 100 ml) must be displayed in retail and online.
  • Textilkennzeichnung: Applies if fragrance products include textile components such as scented sachets.

6. Cost of Compliance

For a typical home fragrance program with 5 to 10 SKUs, expect:

  • CLP classification and label review: EUR 150 to EUR 400 per SKU.
  • Poison Centre notification (UFI): EUR 100 to EUR 250 per formulation.
  • REACH SVHC testing if not covered by supplier documentation: EUR 300 to EUR 800 per SKU.
  • Responsible Person services: EUR 300 to EUR 1,200 per year.
  • LUCID registration and dual-system fees: EUR 80 to EUR 300 per year.

These costs are modest compared with the price of a recall, which German retailers routinely pass back to the importer along with listing fees and disposal costs.

7. Building a Compliance Workflow

The most efficient buyers treat compliance as a stage in product development:

  1. Brief the factory with the target retail channel and product format.
  2. Confirm fragrance IFRA compliance and allergen profile before sampling.
  3. Generate CLP labels in German during the artwork stage, not after production.
  4. Submit the Poison Centre notification before the first container ships.
  5. Maintain a digital technical file per SKU for at least 10 years.

Buyers who align CLP, REACH, IFRA, GPSR, and VerpackG from day one launch faster, retain retail listings, and avoid the fines that affect under-prepared competitors.
